(“Commercial Blue,” “Company,” “we,” “us,” or “our”) (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Effective Date: November 3, 2026Last Updated: November 3, 2026

Please read these terms carefully before using the website because they affect your legal rights and obligations. Your access to, use of and browsing of the website and its contents are subject to these terms, to all applicable laws and regulations.

The Site provides information about Commercial Blue and may enable eligible users to:

  • Request or purchase services;
  • Create and manage customer accounts;
  • Submit property information;
  • Review service plans;
  • Execute service agreements;
  • Establish payment methods;
  • Manage billing;
  • View scheduled services;
  • Review service history;
  • Submit service requests;
  • Receive service updates; and
  • Communicate with Commercial Blue.

These Terms govern use of the Site.

Specific purchased services may be governed by a separate proposal, order, statement of work, contract, or Commercial Blue Service Agreement.

Definitions

For purposes of these Terms:

“Commercial Blue,” “Company,” “we,” “us,” or “our” means Commercial Blue Inc.

“Customer” means a person or entity purchasing, requesting, or receiving Commercial Blue services.

“User,” “you,” or “your” means any individual accessing or using the Site, including an individual acting for a business or other legal entity.

“Customer Portal” means a password-protected online area provided by Commercial Blue through which an authorized Customer may access account and service information.

“Service Agreement” means a separate agreement governing specific Commercial Blue services purchased by a Customer.

“Site” includes Commercial Blue-controlled websites, Lawn Care pages, Customer Portals, and related online functionality.

Eligibility and Authority

You may use transactional portions of the Site only if you are legally capable of entering into the applicable transaction.

If you use the Site on behalf of a company, property owner, organization, or other legal entity, you represent that you have authority to act on behalf of that entity with respect to the actions you take.

Customer Accounts

Certain features require a Customer Portal account.

You agree to provide accurate, current, and complete information and to update information when reasonably necessary.

You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable measures to prevent unauthorized access.

You must promptly notify Commercial Blue if you reasonably believe your account has been compromised.

Commercial Blue may suspend or restrict an account when reasonably necessary to protect customers, the Company, our systems, or other persons.

Lawn Care Services

Commercial Blue may offer residential and commercial Lawn Care services.

Available services may include, depending upon the applicable plan or separately authorized work:

  • Grass cutting/mowing;
  • Trimming;
  • String trimming/weed eating;
  • Edging where included;
  • Blowing of service-related clippings and debris;
  • Routine litter and trash pickup associated with the serviced lawn area;
  • Hedge or shrub services;
  • Weed-control services;
  • Fertilization;
  • Pest-control services; and
  • Other separately quoted property-maintenance services.

The exact scope of purchased services is determined by the applicable Service Agreement, plan description, quote, or work authorization.

Regulated services will be offered or performed only as permitted by applicable licensing and regulatory requirements.

Residential Lawn Care Promotional Plan

Where available, Commercial Blue may offer a promotional residential Lawn Care plan at $50.00 per month.

Unless Commercial Blue expressly states otherwise in writing, eligibility for that promotional plan is limited to qualifying residential properties containing no more than 8,500 square feet of serviceable lawn/turf area, approximately 944 square yards.

Properties exceeding the applicable maximum are not eligible for the $50 promotional rate and may require separately quoted pricing.

Commercial Blue may reasonably verify serviceable lawn area and property conditions before or after enrollment.

Incorrect property information may result in a revised quote, change in eligibility, or other action permitted under the applicable Service Agreement.

Service Agreement

Enrollment in a recurring Lawn Care plan may require execution of a separate Commercial Blue Lawn Care Service Agreement.

The Service Agreement may establish terms concerning:

  • Scope of service;
  • Service frequency;
  • Property eligibility;
  • Agreement duration;
  • Monthly charges;
  • Recurring payment authorization;
  • Customer responsibilities;
  • Scheduling;
  • Weather delays;
  • Cancellation or rescheduling of individual visits;
  • Termination;
  • Additional services; and
  • Other service-specific requirements.

These Site Terms do not replace the Service Agreement.

If a provision of these Terms conflicts with a duly executed Service Agreement regarding the purchased service, the Service Agreement controls with respect to that service to the extent of the conflict.

Electronic Records and Signatures

Commercial Blue may conduct transactions electronically and may use DocuSign or another electronic-signature provider.

When you affirmatively agree to conduct a transaction electronically, you consent to the use of electronic records and electronic signatures for that transaction to the extent permitted by applicable law.

You should retain copies of electronic agreements and transaction records for your records.

Where available, documents may be downloaded or otherwise retained electronically.

DocuSign

Commercial Blue may use DocuSign to:

  • Deliver Service Agreements;
  • Populate agreement information;
  • Obtain acknowledgments;
  • Obtain electronic signatures;
  • Maintain signing status;
  • Maintain transaction records; and
  • Provide completed agreement records.

Use of DocuSign may also be subject to applicable DocuSign terms and privacy practices.

Recurring Billing and Payment Authorization

Certain Commercial Blue services require recurring payments.

Before recurring billing is established, the Customer will be presented with applicable pricing and payment terms through the Service Agreement and/or checkout process.

When a Customer affirmatively authorizes recurring billing, the Customer authorizes Commercial Blue and its authorized payment processor to charge the payment method provided for amounts properly due according to the applicable Service Agreement.

For the promotional Residential Lawn Care plan, the applicable Service Agreement may require a twelve (12) month initial service commitment while payments are collected monthly.

A monthly payment schedule does not, by itself, convert a twelve-month contractual commitment into a month-to-month agreement.

Cancellation or rescheduling of an individual service visit does not by itself terminate the Service Agreement or recurring-payment obligations.

Stripe and Payment Processing

Commercial Blue uses or may use Stripe as an authorized payment processor.

Stripe-provided functionality may be used for:

  • Payment-method collection;
  • Recurring payments;
  • Subscription billing;
  • Invoices;
  • Receipts;
  • Payment-method updates; and
  • Billing management.

Payment information submitted directly through Stripe is subject to Stripe's applicable terms and privacy practices.

Commercial Blue does not intend to directly store complete card numbers or card security codes when payment information is collected through Stripe.

Failed or Past-Due Payments

If an authorized payment cannot be processed, Commercial Blue may:

  • Notify the Customer;
  • Request an updated payment method;
  • Retry payment as permitted;
  • Mark the account Past Due;
  • Suspend or place services on hold as permitted by the Service Agreement; or
  • Exercise other rights available under the Service Agreement or applicable law.

Removing or changing a payment method does not by itself cancel a Service Agreement or eliminate amounts properly due.

Service Scheduling

Commercial Blue may schedule services automatically according to the Customer's applicable service cycle.

Customers may also be permitted to request particular service days.

Requested dates or times are preferences unless expressly confirmed by Commercial Blue and are not guaranteed.

Scheduling may depend upon:

  • Weather;
  • Route optimization;
  • Crew availability;
  • Equipment availability;
  • Property access;
  • Property conditions;
  • Holidays;
  • Safety conditions;
  • Service demand; and
  • Other reasonable operational considerations.

Biweekly Lawn Care Service

Where a Lawn Care plan provides biweekly service, Commercial Blue generally intends to provide service approximately once every two weeks during the applicable service term.

The precise interval may vary because of weather, holidays, route scheduling, property conditions, safety considerations, or other reasonable operational circumstances.

A weather-related or operational scheduling adjustment does not necessarily constitute a missed service or breach of the Service Agreement.

Weather Delays and Rescheduling

Commercial Blue monitors weather forecasts and local conditions as part of service scheduling.

Commercial Blue may delay, reschedule, modify, or cancel a scheduled visit when conditions such as rain, thunderstorms, lightning, tropical weather, flooding, saturated turf, high winds, extreme temperatures, or other conditions could reasonably create safety concerns, damage property or turf, interfere with equipment, or materially reduce service quality.

Commercial Blue will make reasonable efforts to notify affected Customers of material scheduling changes.

Weather decisions may be made in advance based on forecast conditions and do not need to be postponed until the scheduled service time if Commercial Blue reasonably determines that conditions warrant rescheduling.

Customer Requests to Cancel or Reschedule a Service Visit

Customers should provide Commercial Blue at least twenty-four (24) hours' notice when requesting cancellation or rescheduling of an individual scheduled service visit.

Cancellation or rescheduling of an individual visit does not constitute cancellation or termination of the underlying Service Agreement.

Termination of the Service Agreement is governed by the Service Agreement itself.

Property Access and Customer Responsibilities

Customers are responsible for providing Commercial Blue with reasonable and safe access to the service area.

Customers should, as applicable:

  • Provide accurate gate or access information;
  • Secure pets;
  • Unlock necessary access points;
  • Remove movable objects that materially interfere with service;
  • Identify known hazards;
  • Identify sensitive property features;
  • Keep the service area reasonably accessible; and
  • Maintain current property instructions in the Customer Portal.

Commercial Blue may postpone or decline a service visit when reasonable access cannot be obtained or conditions present a material safety concern.

Debris, Litter, and Property Conditions

Where included in the applicable Lawn Care plan, routine litter and trash pickup means reasonable removal of ordinary loose litter encountered within the lawn service area as part of routine service.

Unless expressly included in the Service Agreement or separately authorized, routine Lawn Care does not include removal of:

  • Piled tree limbs;
  • Piled branches;
  • Large quantities of tree debris;
  • Storm debris;
  • Construction debris;
  • Hazardous materials;
  • Bulk waste; or
  • Other unusually large or heavy debris.

Additional cleanup or debris-removal services may be separately quoted.

Additional Services

Commercial Blue may offer additional services outside the Customer's standard Lawn Care plan.

Depending on availability, these may include:

  • Weed-control applications;
  • Fertilizer applications;
  • Pest-control services;
  • Hedge or shrub trimming;
  • Landscape cleanup;
  • Leaf removal;
  • Mulch installation;
  • Tree or storm-debris cleanup; and
  • Other property-maintenance services.

Additional services may require separate authorization, pricing, scheduling, and terms.

Service Status and Notifications

The Customer Portal may display service statuses such as:

  • Scheduled;
  • Crew Assigned;
  • En Route;
  • In Progress;
  • Completed;
  • Delayed;
  • Rescheduled; or
  • Cancelled.

Commercial Blue may provide electronic notifications concerning these statuses.

Portal statuses and estimated arrival information are provided for operational convenience and may change as circumstances require.

Electronic Communications

By providing an email address and using the Customer Portal, you agree that Commercial Blue may provide account, transaction, agreement, billing, scheduling, and service-related communications electronically where permitted by applicable law.

These may include:

  • Account notices;
  • Agreement notifications;
  • Signature requests;
  • Payment notices;
  • Invoice notifications;
  • Scheduling confirmations;
  • Upcoming-service reminders;
  • En Route notices;
  • Weather notices;
  • Rescheduling notices;
  • Completion notices; and
  • Customer-request updates.

Marketing or promotional telephone calls and text messages will be handled separately from ordinary transactional or service-related communications and are subject to applicable consent and opt-out requirements.

Automatic Renewal

Unless the applicable Service Agreement expressly provides for automatic renewal, expiration of the initial agreement term does not automatically create an automatic-renewal obligation merely because recurring payment functionality exists.

If Commercial Blue offers an automatically renewing consumer Service Agreement, the automatic-renewal provision and applicable cancellation procedures will be disclosed in the applicable agreement and administered in accordance with applicable law.

Intellectual Property

The Site and its content, including text, graphics, photographs, designs, interfaces, logos, service marks, trademarks, icons, software, databases, and other materials, are owned by or licensed to Commercial Blue and may be protected by United States and other applicable intellectual-property laws.

Except as expressly authorized, you may not copy, reproduce, republish, modify, distribute, transmit, display, sell, license, create derivative works from, or commercially exploit protected Site content without prior written permission from Commercial Blue or the applicable rights holder.

Commercial Blue Name and Marks

The Commercial Blue name, logos, branding, service names, slogans, and other distinctive identifiers may constitute trademarks, service marks, trade names, or other protected intellectual property.

No license or right to use such marks is granted except as expressly authorized in writing.

Acceptable Use

You may not:

  • Attempt unauthorized access to the Site or another Customer's account;
  • Circumvent security controls;
  • Introduce malware or harmful code;
  • Interfere with Site operation;
  • Scrape or systematically extract Site data without authorization;
  • Impersonate another person;
  • Submit materially false or fraudulent information;
  • Use the Site for unlawful purposes; or
  • Use Commercial Blue systems in a manner reasonably likely to damage the Company, its customers, or third parties.

Commercial Blue may restrict or terminate Site access for violations of these Terms or legitimate security reasons.

Third-Party Links and Services

The Site may contain links to or integrations with third-party services.

Third-party websites and services operate independently and may be governed by their own terms and privacy policies.

Commercial Blue is not responsible for the content, availability, security, products, services, or independent practices of third parties that Commercial Blue does not control.

Site Availability and Modifications

Commercial Blue may modify, maintain, update, suspend, or discontinue Site functionality from time to time.

The Site may occasionally be unavailable because of maintenance, upgrades, internet failures, third-party outages, security events, emergencies, or circumstances beyond Commercial Blue's reasonable control.

Commercial Blue does not guarantee uninterrupted Site availability.

Information on the Site

Commercial Blue endeavors to provide accurate and useful information but does not warrant that all Site content will always be complete, current, or error-free.

Service availability, pricing, promotional terms, scheduling, and other information may change.

A specific written Service Agreement, quote, order, or other transaction document controls over inconsistent general informational Site content relating to that transaction.

Disclaimer of Warranties

COMMERCIAL BLUE DISCLAIMS WARRANTIES REGARDING THE SITE TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

THIS SITE-USE LIMITATION DOES NOT MODIFY LIABILITY EXPRESSLY ASSUMED BY COMMERCIAL BLUE UNDER A SEPARATE SERVICE AGREEMENT AND DOES NOT LIMIT RIGHTS OR REMEDIES THAT CANNOT LAWFULLY BE WAIVED.

Privacy

Use of the Site is subject to the Commercial Blue Inc. Privacy Policy, incorporated by reference as applicable.

Changes to These Terms

Commercial Blue may revise these Terms to reflect changes in Site functionality, business practices, or applicable law.

The current version will display its effective or “Last Updated” date.

Material changes will be communicated when required by applicable law.

Changes to these Site Terms do not retroactively modify an executed Service Agreement except where permitted by that agreement and applicable law.

Governing Law

These Terms and disputes arising from use of the Site are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

Any mandatory consumer right or venue requirement imposed by applicable law remains unaffected.

Severability

If a provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

No Waiver

Commercial Blue's failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

Entire Agreement Regarding Site Use

These Terms, together with the Privacy Policy and other policies expressly incorporated into them, constitute the agreement between you and Commercial Blue concerning use of the Site.

Specific Commercial Blue services remain subject to their applicable Service Agreements, quotes, orders, or other contractual documents.
